Terms of Service

Welcome to InstaRoomBookings, a service operated by EMPMachines LLC ("we", "us", "our") that connects renters with independently-operated spaces ("rooms") offered by third-party owners. By creating an account or using the platform, you agree to these Terms of Service.

SMS messaging program

Our Privacy Policy describes how we collect, use, and protect information associated with the SMS program.

Program name: InstaRoomBookings Reservation Notifications

Description: Transactional SMS notifications sent to users who have opted in to receive reservation-related text messages after booking a room through InstaRoomBookings. Messages include reservation confirmations, upcoming-booking reminders (approximately one hour before your reservation begins), notices related to reservations immediately before or after yours on the same space, and cancellation notices.

Frequency: Approximately 1–3 messages per reservation.

Cost: Message and data rates may apply. InstaRoomBookings does not charge you for messages, but your mobile carrier's standard rates apply based on your plan.

Opt out: Reply STOP to any message to unsubscribe. You will receive a confirmation message and no further texts.

Help: Reply HELP to any message, or contact us at support@instaroombookings.com.

Carriers: Supported by all major U.S. carriers. Carriers are not liable for delayed or undelivered messages.

Opting out of SMS does not affect your ability to use the platform. You will continue to receive the same transactional notices via email.

InstaRoomBookings does not sell, rent, or share mobile phone numbers, messaging opt-in data, or SMS consent information with any third parties or affiliates for marketing or promotional purposes.

We may disclose phone numbers to service providers, such as Twilio, Inc., solely as necessary to deliver the transactional SMS messages you have requested. These service providers may not use your phone number or SMS consent information for their own marketing or promotional purposes.

Your account

You must be at least 18 years old to create an account. You are responsible for keeping your password secure and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access.

Bookings and payments

  • When you reserve a room, you agree to pay the amount shown at checkout (including any processing fees) using a valid payment method.
  • Payments are processed by Stripe. We do not store your card details.
  • The room owner receives the majority of your payment; InstaRoomBookings retains a platform commission.
  • Cancellations and refunds are handled through your reservation page. Refunds are subject to the room's posted cancellation policy.

Room owners

If you list a room as an owner, you agree to:

  • Complete Stripe Connect onboarding, including identity verification and bank details, before receiving payouts.
  • Make the space you list available at the times you offer, at the price you set.
  • Handle any physical safety, licensing, or insurance obligations for your space. You are responsible for the quality, safety, and legality of the space you offer and the services you provide within it.
  • Comply with all applicable laws, including tax reporting obligations for the income you receive.

Prohibited uses

You may not:

  • Use the platform to book or offer any unlawful or harmful activity.
  • Attempt to circumvent the platform to avoid paying commission or to conduct transactions outside of InstaRoomBookings.
  • Reverse-engineer, scrape, or attempt to gain unauthorized access to any part of the platform.
  • Impersonate another user or misrepresent your affiliation.

Content and communications

Class titles, room descriptions, and other content you submit must be your own or properly licensed. You grant us a limited, non-exclusive license to display that content within the platform for the purpose of operating the service. We reserve the right to remove content that violates these Terms.

Disclaimers

The platform is provided "as is" without warranties of any kind. We do not warrant that the service will be uninterrupted or error-free. We are not responsible for the quality, safety, legality, or accuracy of any room or service offered by third-party owners. Any dispute over a booking should first be raised with the owner; we will assist in good faith but are not a party to your booking contract.

Limitation of liability

To the fullest extent permitted by law, EMPMachines LLC's total liability for any claim arising out of your use of the platform is limited to the amount of platform fees you have paid us in the twelve (12) months preceding the claim.

Termination

You may delete your account at any time from your profile page (subject to admin review to resolve outstanding bookings and payouts). We may suspend or terminate accounts that violate these Terms.

Governing law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-laws rules. Any disputes will be resolved in the state or federal courts located in Texas.

Changes to these terms

We may update these Terms from time to time. When we make material changes we will update the "Last updated" date above and notify you by email when appropriate. Continued use of the platform after changes means you accept the new Terms.
